Terms of Service

§ 1. General Provisions

  1. These Terms of Service govern the use of the website and services provided by PEAK Performance Group GmbH. By accessing the site or using our services, you agree to be bound by these terms.
  2. Our services are intended for business professionals and organizations. The client acknowledges that the coaching services provided are not psychological counseling or therapy. The services are for professional development purposes only.
  3. PEAK Performance Group reserves the right to modify these terms at any time. We will provide notice of any significant changes, and continued use of our services constitutes acceptance of the new terms.
  4. The agreement between the client and PEAK Performance Group is governed by the laws of Austria. Any disputes shall be resolved in the competent courts of Vienna, Austria.

§ 2. Definitions

  • Platform – Refers to the website https://peakperformance.eu and all its subdomains and content.
  • User/Client – Refers to any individual or legal entity that uses the Platform or engages in a service agreement with PEAK Performance Group.
  • Account – Refers to the user-specific portal for accessing resources or managing service details on the Platform.
  • Services – Refers to all executive coaching, workshops, and consulting provided by PEAK Performance Group as detailed in a specific service agreement.
  • Regulations – Refers to these Terms of Service.

§ 3. Type and Scope of Services Provided

  1. PEAK Performance Group provides bespoke executive coaching and leadership development services. The specific scope, duration, fees, and objectives of the services will be detailed in a separate, written coaching agreement signed by both the Client and PEAK Performance Group.
  2. Access to the resource hub on the Platform is provided free of charge upon registration. PEAK Performance Group reserves the right to modify or restrict access to these resources at any time.
  3. The Client is responsible for their own progress and results. The coach's role is to provide support, guidance, and accountability. The Client agrees to be open, honest, and committed to the process.
  4. All information shared by the Client during coaching sessions will be held in the strictest confidence, except where required by law. This confidentiality is paramount to the coaching relationship.

§ 4. Technical Requirements

  1. To use the Platform and virtual services, the User must have a device with internet access and a current web browser. The User is responsible for ensuring their technical setup is adequate.
  2. PEAK Performance Group is not responsible for any technical issues or limitations on the User's end that may prevent access to services.
  3. The Platform may be temporarily unavailable due to maintenance or technical issues. We will endeavor to minimize any disruption.

§ 5. Rights and Obligations of the User

  1. The User agrees to provide accurate and current information during registration and engagement. The User is responsible for maintaining the confidentiality of their account password.
  2. The User agrees not to use the Platform or services for any unlawful purpose. All content on the Platform is the intellectual property of PEAK Performance Group and may not be reproduced without permission.
  3. The Client agrees to be punctual for all scheduled sessions. Cancellations or rescheduling requests must be made at least 48 hours in advance, as specified in the coaching agreement, otherwise the session may be forfeited without refund.
  4. Payment for services must be made in accordance with the terms outlined in the coaching agreement. Failure to make timely payments may result in the suspension of services.
  5. The User grants PEAK Performance Group the right to use anonymized and aggregated data for research and case studies, with all personally identifiable information removed.

§ 6. Final Provisions

  1. If any provision of these Regulations is found to be invalid, the remaining provisions will continue to be in full force and effect. The invalid provision will be replaced by a valid one that best achieves the original intent.
  2. Any matters not covered by these Regulations will be governed by the applicable provisions of Austrian law.
